Mujtahid who determines preference

A fiqh scholar who has diligently studied his school of fiqh, knows the evidences and able to establish these, clearly stating and explaining these, and shows the inadmissibility of what is contrary to them. He is further able to choose what is preferable of the views of the founder of his school and other views by the founder’s disciples. He has not attained the grade of a mujtahid in his school, or mujtahid al-takhrīj, because he only has studied his own school of fiqh.
