Oaths (أَيْمانٌ)

Oaths (أَيْمانٌ)

أصول الفقه

المعنى الاصطلاحي :

Confirming a statement by mentioning a glorified entity in a specific wording.

الشرح المختصر :

"Aymaan" (oaths) refer to any verbal statement that includes consolidation and affirmation of that statement through mentioning a revered entity such as the Name of Allah, the Exalted, or one of His attributes. "Aymaan" also include conditional statements, intended for making something contingent upon the occurrence of a specific action. Examples of those conditional statements are: turning disbeliever, divorce, "zhihaar", committing a sin, manumission of a slave, or commitment to do a righteous act conditional on the occurrence of a certain action. For example, a man says to his wife: If you enter the house, you are divorced. There are four types of oaths: 1- "Yameen ghamoos" (immersing oath, which dips the one who took it into sin then into Hell): it is to falsely swear to have done or have not done a certain thing in the past. 2- "Yameen laghw" (idle or mistaken oath): it is to swear on something believing it to be such-and-such, while, in fact, it is otherwise. 3- "Yameen mun`aqidah" (enacted/effective oath): it is to swear about doing or not doing something in the future. 4- "Yameen sabr": it is when a person purposefully lies in his oath with the aim of seizing the wealth of someone else. It was called as such due to the person's audacious perseverance in taking it, although there is a severe threat for those who do so.
