variance in assumption (تَفَاوُتُ الظُّنُونِ)

أصول الفقه

التعريف :

This is a theological question which scholars of principles of jurisprudence mention along with the question of variance in knowledge. It says: ‘assumption admits the description of being stronger or weaker’. For example, when a woman has had one menstruation period, it is assumed that she is not pregnant, but the same assumption is different when she has had three consecutive menstrual periods. In both situations, non-pregnancy is assumed.
