الدعاوى والبيِّنات
Abu Mūsa reported: Two men referred a dispute to the Prophet (may Allah's peace and blessings be upon him) concerning an animal. As neither of them had any evidence, he ruled that they share it equally.  
عن أبي موسى «أن رجلين اخْتَصَمَا إلى النبي -صلى الله عليه وسلم- في دَابَّةٍ ليس لِوَاحَدٍ منهما بَيِّنَةٌ فَقَضَى بَهَا بينهما نِصْفَينِ».

شرح الحديث :


In this Hadīth, two men disputed over an animal, each of them claiming that it belonged to them, but they had no proof, witnesses, or other evidence. As they were raising equal cases, the Prophet (may Allah's peace and blessings be upon him) judged that they should share the animal, as they both had an equal right to own it. They could therefore either slaughter it and share the meat, sell it and share the amount, or use it alternately for defined periods of time.
