Making two sale agreements in one contract
الشرح المختصر
“Bayʿatān fee bayʿah” (two sales in one contract) is a type of forbidden sales because it involves deception and ignorance. There are many forms of this transaction, shown in three cases: 1. To give two different prices for the same commodity. For example, a person sells a commodity for a certain price in cash, yet for a higher price on credit. Then they separate from each other without agreement on one of the prices. 2. To give out two commodities at one price. For example, someone says: I will sell you my car or my building for ten thousand dollars. You might want to buy the car, but he draws your attention to the building instead, and vice versa. 3. To conclude two deals in one contract. For example, one says: I sell you this horse for one thousand, provided that you sell me your house for such price.
