المعنى الاصطلاحي :


The place where the wife resides with her husband by virtue of a marriage contract.

الشرح المختصر :


"Bayt az-zawjiyyah" (marital home) is the accommodation that the husband provides for his wife as a consequence to the marriage contract, whether it is a house, a room, or otherwise. It is an individual place that is particular to the wife and none of her in-laws who have reached the age of discernment share with her. It has a door that can be locked as well as utilities. The term "zawjiyyah" is derived from "zawāj" (marriage), which is a contract that allows a man and a woman to seek sexual pleasure in each other lawfully. The level of "bayt az-zawjiyyah" is determined according to the financial situation of the spouses and the customary practice of the people in their country. It was also said that its level is determined according to what befits the woman's status or according to the financial situation of the husband, whether rich or poor or middle-class, just like the maintenance he is obliged to provide for his wife.
