المعنى الاصطلاحي

Adopting secret methods which could not be detected except by wit and insight in order to achieve a certain purpose.

الشرح المختصر

"Heelah" (trick) is classified into two categories in terms of permissibility: 1. Permissible "heelah": It is used to get rid of something wrong, achieve something lawful, claim a right, or eliminate some evil. It does not violate a permissible principle nor contradicts a Shariah-approved benefit. Example: using "heelah" in the realization of benefits and the elimination of evils by using permissible allusions in speech. 2. Forbidden "heelah": It is used to achieve something unlawful, invalidate a right, conceal falsehood, or make it seem confusing. It is based on deceit, fraud, and adopting legal or illegal means to reach what is unlawful. Example: one who divorces his wife thrice and wants to take her back without a "muhallil" (another who marries her and consummates the marriage with her and then divorces her, thus making her lawful in marriage to the first husband again) and uses the trick of claiming the marriage to be invalid because of the immorality of the guardian or the witnesses, hence divorce becomes invalid since the marriage contract was invalid in the first place.

التعريف اللغوي المختصر

"Heelah": what is used as a means to reach something secretly. Derived from "hawl", which means a shift from one state to another in a secret manner. It is mostly used in things contain malice.
