assumed unanimity (الإِجْمَاعُ الظَّنِّي)

التعريف :


A unanimous decision that does not meet one of the two conditions of absolute unanimity, namely: 1) an express statement of the ruling by the unanimous scholars, and 2) transmission in the tawātur degree [i.e. by large numbers]. It thus includes silent unanimity and express unanimity transmitted by single reporters. Most cases of unanimity mentioned in books of fiqh scholars are of this type.
