Delegating (اسْتِنابَةٌ)

المعنى الاصطلاحي :


Delegating someone to perform Hajj (pilgrimage) on one's behalf.

الشرح المختصر :


"Istinābah" (delegating) means authorizing another person to do something as one's representative or delegate, be it something verbal or an action. There are two types of "istinābah": 1. "Istinābah" based on agreement: it is established by designation on part of the owner, and this is called "wakālah" (authorization). 2. "Istinābah" based on the Shariah: it is established in accordance with the Shariah, not by designation on part of the owner, and this is called "wilāyah" (guardianship).
