التعريف :


That one of the parties to the contract stipulates in the meeting when the contract is agreed that the contract may stand or be cancelled after seeing the sold item(s).

المعنى الاصطلاحي :


Establishing the right of the buyer to proceed with the contract or cancel it when he sees the purchased commodity if he had not seen it at the time of making the contract or before it.

الشرح المختصر :


"Khiyār-ur-ru’yah" (commodity's sighting choice) is when one buys something without seeing it, thus, he gets the right of either cancelling the sale or continuing with it upon seeing the purchased object, which is specified in the contract and which he bought without seeing. That choice pertains only to the sale that is made by description or the sale of the absent object, i.e. the invisible, either for its not being present or for not seeing it despite its presence. "Khiyār-ur-ru’yah" takes place either by actual seeing or by any other sense, like touching, tasting, smelling, or hearing, depending on the nature of the purchased object.
