Al-Mughīrah ibn Shu‘bah (may Allah be pleased with him) reported that the Messenger of Allah (may Allah's peace and blessings be upon him) said: "The wife of a lost man remains his wife until she receives news about him."

شرح الحديث :

This Hadīth outlines the ruling of a woman whose husband is lost, when she gets no more news about him or his whereabouts are unknown. The ruling is that she waits, even for a long time, as long as she is not harmed by waiting, until she gets news of her husband being alive of dead. She would then build her judgment on what she is certain of. That is because the basic ruling is that the person was alive for certain, while his death is a matter of doubt. So a certain thing is not left in favor of something doubtful.
