أصول الفقه

المعنى الاصطلاحي :

A specific case of division of inheritance where the total shares become 27 instead of 24.

الشرح المختصر :

"Bakheelah" (a specific case of inheritance where total shares become 27 instead of 24) is one of the cases of "‘awl" (increment of base number) in determining the shares of inheritance. It is called as such because it is the case where the total shares undergo the least amount of "‘awl". It is also called "minbariyyah" because ‘Ali, may Allah be pleased with him, was asked about it while he was on the "minbar" (pulpit). "‘Awl" means an increase of the total number of shares and decrease in the amount every heir receives from the inheritance. It could also be defined as a situation in which the actual number of shares exceed the original number (after changing the base number to the lowest common denominator when adding the share fractions).

التعريف اللغوي المختصر :

"Bakheelah": feminine form of "bakheel": a miser who is unwilling to spend money and withholds it from those who deserve it.
