“Tahāluf” refers to the situation in which each party to the contract takes an oath to affirm his own version and deny the one offered by the other party.
An example of “tahāluf” is when a conflict arises between a buyer and a seller, and neither of them can produce evidence. So each one turns into a plaintiff and a defendant at the same time, and the judge settles the dispute by asking each one to take an oath.
“Tahāluf”: when each person seeks an oath from the other. It is derived from “halif” or “hilf”, which means an oath. Other meanings: entering into a contract or agreement.
