التعريف :


A killing that takes place without prior intention or aiming at that person, or without either of these.

المعنى الاصطلاحي :


Killing that takes place without intending the act of killing and the person being killed, or without intending one of them.

الشرح المختصر :


"Qatl khata’" (unintentional killing/manslaughter) is of two types: 1. Killing someone without the deliberate intention of harming him, rather it happens while being inattentive, like, for instance, when a plank of wood falls from someone's hand on someone else, causing his death. 2. Killing someone while mistaking him for someone else, like, for instance, when a man kills someone thinking that he is a disbeliever fighting against the Muslims and finds out later that he is a Muslim.
