حد أهل البغي
Ibn ‘Umar (may Allah be pleased with him) reported that the Prophet (may Allah's peace and blessings be upon him) said: "Do you know, O Ibn Umm ‘Abd, what the ruling of Allah is concerning those who rebel from among this Ummah (against the ruler)?" He said: "Allah and His Messenger know best." The Prophet (may Allah's peace and blessings be upon him) said: "A wounded one among them is not to be given the last stroke (that kills him), their captive is not to be killed, the one who runs away is not to be chased, and their booties are not to be divided."
عن ابن عمر أن النبي -صلى الله عليه وسلم- قال: يا ابن أم عبد، هل تدري كيف حكم الله فيمن بغى من هذه الأمة؟ قال: الله ورسوله أعلم. قال: لا يُجْهَزُ على جريحها، ولا يقتل أسيرها، ولا يطلب هاربها، ولا يقسم فيئها.
شرح الحديث :
In this weak Hadīth, the Prophet (may Allah's peace and blessings be upon him) asked Ibn Mas‘ūd (may Allah be pleased with him) about the ruling of Allah, the Almighty, concerning the Muslims who rebel against the ruler of the Muslims based on a justifiable or excusable interpretation according to Shariah, and who took up arms and seceded from the Muslim community. Ibn Mas‘ūd (may Allah be pleased with him) answered that he did not know that ruling, so, the Prophet (may Allah's peace and blessings be upon him) explained to him that fighting such rebels is only permissible to ward off their evil, but there are some rulings specific to them in this regard: - When one of them is wounded, he is not to be given the last stroke that kills him; rather, he should be left alive. - If one of them is taken captive, he is not to be killed. - If one of them runs away, he is not to be chased. - If their money and properties are seized, they are not to be divided or treated like war booty taken from the disbelievers. Rather, their money and properties remain protected, and taking them is prohibited.
