fulfilment (التَّنْجِيزُ)

الفقه أصول الفقه

التعريف :

To fulfil the matter in hand and complete it on time, without delay, as in giving the money being exchanged on the spot.

المعنى الاصطلاحي :

Immediate implementation of an action instantly without a delay, such as application of divorce without suspension or deferment.

الشرح المختصر :

"Tanjeez" (immediate implementation) is implementation of an action without a delay; such that the consequences of that action become effective as soon as the action occurs. An example is when a man says to his wife: You are divorced. She becomes divorced immediately. This is contrary to making the divorce conditional or deferred whereby the divorce is not implemented until the condition is met. For example, when a man says to his wife: You are divorced if you enter the house. Divorce in this case does not occur until she enters the house. Actions are of two types: 1. Actions wherein "tanjeez" is mandatory and they do not accept conditionality or deferment, such as most contracts, like the sale contract and the like. 2. Actions that are liable to conditionality or deferment such as divorce and the like. Conditionality means making the occurrence of one thing conditional upon the occurrence of another.

التعريف اللغوي المختصر :

"Tanjeez": implementation and immediateness. Other meanings: finishing.
