(الْمَبْتُوتَة)

من موسوعة المصطلحات الإسلامية

المعنى الاصطلاحي

The woman whose husband divorced her thrice and has become unlawful for him unless she marries another man.

الشرح المختصر

"Mabtootah" (irrevocably-divorced woman) is the woman whose husband divorced her terminally by divorcing her thrice, whether the divorce included compensation or not, as in the case of "khul‘" (wife-initiated divorce). She is also called "bā’in baynoonah kubra". In this case, it is not lawful for him to marry her again except if she marries another man and they consummate the marriage and she then completes her "‘iddah" (waiting period) after he divorces her willingly or dies. After that, she may return to her first husband with a new marriage contract.

التعريف اللغوي المختصر

"Mabtootah": derived from "batt", which originally means cutting. "Batt" is also used to mean the finalization of something to the point of no return. A woman is said to be "mabtootah" when she becomes irrevocably divorced, because the husband cut the chance to take her back in marriage. Other meanings of "batt": terminating, compelling, and resolving (a matter) decisively.

التعريف

A wife whose husband has divorced her, and he cannot re-instate their marriage until she has married a different man and then became free.
