Ibn ‘Umar (may Allah be pleased with him) reported: The Messenger of Allah (may Allah's peace and blessings be upon him) forbade that a man relieves himself under a fruitful tree or on the bank of a flowing river.

شرح الحديث :

Hadīth explanation: "The Messenger of Allah (may Allah's peace and blessings be upon him) forbade that a man relieves himself under a fruitful tree," meaning that it is not permissible for a person to urinate or defecate underneath trees that bear fruits that are useful either as food or any other form of benefit. This is because doing so makes people disgusted of them. Also, some of the fruits might fall from the tree and become contaminated with impurities, or perhaps the tree would absorb some of these impurities thus affecting the fruits, and then people would be deprived of its benefit. As for the trees whose fruits are not useful or that do not bear fruit, there is no harm in relieving oneself underneath them, because doing so will not result in harming people, except if the tree has shade that people benefit of. In this case as well, it is not permissible to relieve oneself underneath it because it has benefit for people. "Or on the bank of a flowing river," means that the Prophet (may Allah's peace and blessings be upon him) forbade urinating or defecating on river banks, because it is one of the facilities that people frequent. The same applies to irrigation canals and open pipes in which water flows to the farms, or irrigation canals and wells where water gathers. This Hadīth is weak; however, the prohibition of relieving oneself in places of use for people is deduced from authentic evidence. Abu Hurayrah (may Allah be pleased with him) reported that the Messenger of Allah (may Allah's peace and blessings be upon him) said: "Beware of the two cursed ones." They said: "What are the two cursed ones, O Messenger of Allah?" He said: "The one who relieves himself on the roads that people use or in their places of shade." [Muslim]
